1.Acceptance of These Terms

These Terms and Conditions (the “Terms”) govern your access to and use of the website at kimmackymedium.com (the “Site”) and any sessions, programs, immersions, consultations, digital content, and related services (collectively, the “Services”) offered by KM Inc. (“Kim Macky,” “we,” “us,” or “our”).

By accessing the Site, booking or attending a session, submitting an inquiry, or otherwise engaging any Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy practices described in Section 16. If you do not agree, please do not use the Site or the Services.

2.Eligibility

The Services are intended for adults. You represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. Services are not directed to children, and we do not knowingly provide Services to minors without the written consent and participation of a parent or legal guardian.

3.The Services

Kim Macky offers energy transformation sessions and related programs, including online and in-person sessions, home and space clearing, and the invitation-level private intensive known as The Private Immersion™. Some offerings are referred or fulfilled through affiliated ventures within the Kim Macky universe (see Section 12).

We may add, modify, suspend, or discontinue any Service, or any feature of the Site, at any time. The specific scope, format, and deliverables of a given engagement are those described at the time of booking or, for private engagements, in a separate written agreement.

4.No Medical, Psychological, or Professional Advice

The Services are not medical, psychological, psychiatric, or other licensed healthcare or professional services, and are not a substitute for them. Kim Macky is not a physician, licensed therapist, counselor, or financial, legal, or other licensed professional, and the Services do not constitute diagnosis, treatment, cure, or prevention of any physical, mental, emotional, or medical condition.

Nothing said or provided in connection with the Services should be relied upon as professional advice. You should always seek the advice of a qualified physician or other licensed professional regarding any medical, psychological, financial, or legal matter, and never disregard or delay seeking such advice because of anything experienced through the Services.

• Do not stop, start, or change any medication, treatment, or professional care based on the Services.
• If you are experiencing a medical or mental-health emergency, call your local emergency number or seek immediate professional help.

By engaging the Services, you accept full responsibility for your own physical, mental, emotional, and financial wellbeing and for any decisions you make.

5.No Guarantee of Results

Energy work is experiential and individual. Outcomes vary from person to person and depend on many factors outside our control. We make no representation, warranty, or guarantee of any specific result, benefit, or outcome from any Service. Any examples, testimonials, or descriptions of past experiences are illustrative only and are not promises of your results.

6.Booking, Payments, and Pricing

Sessions and certain offerings may be booked and paid for through the Site. All prices are stated in U.S. dollars (USD) unless otherwise noted and are exclusive of any applicable taxes, which are your responsibility where required by law.

Payment is processed through our third-party payment and scheduling providers; by paying, you also agree to those providers’ terms. We are not responsible for the acts, omissions, or security practices of third-party processors. Bookings are confirmed only when payment is received and a confirmation is issued.

Payment due at time of booking to confirm the requested scheduled session. The post-submit confirmation is proof of purchase. All sales are recorded and verified as proof of purchase.

Published session pricing is set out on the Site and may change at any time; the price applicable to your booking is the price shown at the time you book. [Confirm current published prices and any deposit terms before publishing.]

7.Cancellations, Rescheduling, and Refunds

We ask that you give as much notice as possible if you need to reschedule or cancel. The following standard policy applies unless a different policy is stated for a specific Service or in a separate written agreement:

• Availbility / Rescheduling: sessions may be rescheduled with at least [48 hours] advance notice, rescheduling subject to availability. No guarantees can be made of next availabile opening and duration of wait. Refunds do not qualify due to rescheduling requests and availability. All sales final.
• Late cancellations / no-shows: cancellations made with less than [24] notice, or missed appointments, do not qualify for rescheduling and forfeit all deposits and fees paid. No exceptions.
• Refunds: fees for booked sessions are non-refundable. No refunds for rescheduling, cancellations, and no-shows [All Sales Final.]

Deposits and terms for The Private Immersion are addressed in Section 8 and in the separate engagement agreement.

8.The Private Immersion™ — Confidentiality and Mutual Non-Disclosure

The Private Immersion™ is a private, invitation-level engagement. Submitting a private inquiry does not create a client relationship, and it does not by itself impose any binding confidentiality obligation on either party beyond the data-handling commitments described in Section 16.

Before any Private Immersion engagement begins, both parties will enter into a separate, written Mutual Non-Disclosure Agreement (NDA), together with an engagement agreement that sets out scope, fees, scheduling, deposit, travel, and any bespoke terms. Those signed documents — not these Terms — govern confidentiality and the specific terms of the engagement, and they control to the extent of any conflict with these Terms.

Under the Mutual NDA, each party agrees to keep confidential the identity of the other, the existence and contents of the engagement, and any non-public information exchanged, except as required by law. No names, references, testimonials, or public disclosures are made about a Private Immersion client without that client’s prior written consent.

Deposits and minimum-investment terms for The Private Immersion are set out in the engagement agreement and are non-refundable except as expressly stated there.

9.Confidentiality of Client Information

We treat the personal information and the content of sessions shared with us as confidential and use it only to provide and improve the Services, except where disclosure is required by law, is necessary to prevent serious harm, or is authorized by you. This Section describes our general practice for all clients; specific engagements (such as The Private Immersion) may be governed by additional confidentiality obligations under a separate signed NDA.

10.Client Responsibilities and Conduct

You agree to provide accurate information, to arrive prepared and on time, and to engage the Services lawfully and respectfully. You are responsible for your environment during online or in-person sessions and for the safety and suitability of any location you provide for in-person work or home clearing. We may decline, pause, or end a Service, without refund, where conduct is abusive, unlawful, or unsafe.

11.Intellectual Property

The Site and its content — including text, graphics, logos, the sacred-geometry emblem and related marks, designs, audio, video, and methods — are owned by or licensed to KM Inc. and are protected by intellectual-property laws. “Kim Macky,” “The Private Immersion,” and associated marks are claimed as trademarks of their respective owners.

You are granted a limited, personal, non-transferable, revocable license to access the Site and any content provided to you solely for your own non-commercial use. You may not copy, reproduce, distribute, publicly display, modify, resell, or create derivative works from any content without our prior written consent.

12.Third-Party Links, Ventures, and Services

The Site links to and references affiliated ventures and third-party sites, including The Mirror Code, Luv & Light, Longevity Life, and the Kim Macky universe hub at https://www.kimmacky.com, as well as third-party booking, payment, and communication providers. These are operated under their own terms and privacy policies. We are not responsible for the content, products, services, or practices of any third-party site or provider, and your dealings with them are solely between you and that third party.

13.Assumption of Risk and Release

You voluntarily choose to participate in the Services and accept all associated risks. To the fullest extent permitted by law, you release and hold harmless Kim Macky and its owners, officers, contractors, and agents from any claims, demands, or damages arising out of or related to your participation in the Services, except to the extent caused by our gross negligence or willful misconduct.

14.Limitation of Liability

To the fullest extent permitted by law, in no event will KM Inc. or its owners, officers, contractors, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to the Site or the Services, whether based in contract, tort, or any other theory, even if advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or related to the Services will not exceed the amount you actually paid to us for the specific Service giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15.Indemnification

You agree to indemnify, defend, and hold harmless Kim Macky and its owners, officers, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any law or the rights of any third party.

16.Privacy

We collect and use the information you provide (such as your name, email, and the contents of your inquiries and sessions) to respond to you, deliver and improve the Services, and operate the Site. We use reputable third-party providers for scheduling, payment, email, and analytics, each subject to their own privacy practices. We do not sell your personal information.

You may request access to or deletion of your personal information by contacting us at kimmackymedium@gmail.com, subject to legal and record-keeping requirements. [Send email request for separate Privacy Policy that may or may not confirm any CCPA/GDPR obligations with counsel.]

17.Communications and Electronic Consent

By contacting us or engaging the Services, you consent to receive communications from us electronically, including by email, regarding your bookings and engagements. You may opt out of non-essential communications at any time. Notices to us should be sent to kimmackymedium@gmail.com.

18.Force Majeure

We are not liable for any failure or delay in performing the Services caused by events beyond our reasonable control, including illness, travel disruption, acts of nature, utility or network failures, or governmental actions. Where such an event occurs, we will work with you in good faith to reschedule or otherwise address the affected Service.

19.Governing Law and Dispute Resolution

These Terms are governed by the laws of [Governing law - State of California, USA], without regard to its conflict-of-laws rules. The parties will first attempt to resolve any dispute informally by contacting us at kimmackymedium@gmail.com.

If a dispute cannot be resolved informally, it will be resolved by [binding arbitration / the state and federal courts located in [Orange Coundty, CA, USA]], and you and we agree to that exclusive forum. [State of California, USA, Orange County District Court, Santa Ana CA, arbitration vs. courts, and any class-action waiver with your attorney.]

20.Changes to These Terms

We may update these Terms from time to time. The current version will always be posted on this page with its effective date. Material changes take effect when posted, and your continued use of the Site or the Services after that constitutes acceptance of the updated Terms. Please review this page periodically.

21.Severability and Entire Agreement

If any provision of these Terms is found unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force. These Terms, together with any policies referenced here and any separate written agreement you sign with us (which controls in case of conflict), constitute the entire agreement between you and us regarding the Services.
